<div style="margin: 0; outline: none; padding: 0;"><span style="color: inherit; font-size: inherit; font-weight: bold; line-height: inherit; text-decoration: inherit;"><br >25. Mai 2021<br ><br ><strong style="margin: 0; outline: none; padding: 0; font-size: 24px; mso-bidi-font-weight: normal;"><span style="color: inherit; font-size: inherit; font-weight: inherit; line-height: inherit; text-decoration: inherit; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: DE;"><strong style="margin: 0; outline: none; padding: 0; mso-bidi-font-weight: normal;"><span style="color: inherit; font-size: 24px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Bundesrat soll Inhaftierung von Kindern in Abschiebungsgefängnissen ausschließen</span></strong><br ></span></strong> <strong style="margin: 0; outline: none; padding: 0; mso-bidi-font-weight: normal;"><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Flüchtlingsorganisationen unterstützen schleswig-holsteinische Gesetzesinitiative</span></strong><br ><br ></span> <span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Die Landesflüchtlingsräte und PRO ASYL begrüßen die Initiative Schleswig-Holsteins im Bundesrat, die Inhaftierung von minderjährigen Kindern und Jugendlichen – allein oder im Familienverbund – zwecks folgender Abschiebung grundsätzlich gesetzlich auszuschließen.<br ></span><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit; font-family: arial;">Martin Link, Geschäftsführer beim Flüchtlingsrat Schleswig-Holstein, erklärt dazu: "Die Landesflüchtlingsräte lehnen Abschiebungshaft und erst recht die Inhaftierung von Familien und Minderjährigen grundsätzlich ab." Nach den Regelungen der UN-Kinderrechtskonvention, an die Deutschland völkerrechtlich gebunden ist, sei eine Inhaftierung von Minderjährigen vor einer geplanten Abschiebung unverhältnismäßig und ein Verstoß gegen das Kindeswohl.</span><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit; font-family: arial;"><br >Dem trage der Antrag im Bundesrat Rechnung erklärt Günter Burkhard, Geschäftsführer bei PRO ASYL: "Wir fordern alle Landesregierungen auf, dem Vorhaben am Freitag zuzustimmen, damit der Bundestag diese überfällige Gesetzesänderung noch vor der Sommerpause beschließen kann!"<br ></span><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit; font-family: arial;">Die Landesflüchtlingsräte und PRO ASYL weisen darauf hin, dass der vorliegende Gesetzesantrag die Frage der möglichen Inhaftierung von Minderjährigen an Flughäfen (§ 18a AsylG) außen vorlässt. Die Verbände fordern, dass Haft Minderjähriger zwecks Abschiebung ausnahmslos gesetzlich untersagt wird und dieser Passus daher in den Gesetzentwurf aufgenommen wird.<span style="color: inherit; font-size: inherit; font-weight: inherit; line-height: inherit; text-decoration: inherit; mso-spacerun: yes;">  <br ></span></span><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit; font-family: arial;">"Geflüchtete Kinder und Jugendliche sind regelmäßig aufgrund der Erlebnisse ihrer nicht selten lebensgefährlichen Flucht als schwer belastet und traumatisiert zu betrachten", mahnt Dorothee Paulsen vom lifeline-Vormundschaftsverein für unbegleitete minderjährige Flüchtlinge in Schleswig-Holstein. Diese Kinder daraufhin neben der zwangsweisen Abschiebung auch noch der Inhaftierung anheim zu stellen, sei als strukturelle Körper- und Kindeswohlverletzung entschieden abzulehnen.<br ></span><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Auch das Grundgesetz und die Europäische Menschenrechtskonvention stehen der Inhaftierung Minderjähriger deutlich entgegen. Der Verfassungsgrundsatz der Verhältnismäßigkeit verbietet deswegen auch die Zivilhaft für Minderjährige in praktisch allen Fällen. Minderjährige Geflüchtete sind als besonders Schutzbedürftige gem. Art. 21 der EU-Aufnahmerichtlinie, die insbesondere Alleinerziehende und deren Kinder schützt, zu betrachten.</span> <br style="font-size: 12px; font-family: arial;"><br ><strong style="margin: 0; outline: none; padding: 0;"><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Hintergrund</span></strong><br ><span style="color: inherit; font-size: 12px; font-weight: inherit; line-height: inherit; text-decoration: inherit;">Die Landesregierung Schleswig-Holstein hat am 04. Mai 2021 einen Gesetzesantrag beim Bundesrat vorgelegt (<a href="https://proasyl.gu-marketingsuite.com/Prod/link-tracker?redirectUrl=aHR0cHM
