Erste Reformvorschläge der Kommission von 2016 scheiterten an der Zerstrittenheit der EU-Mitgliedstaaten über die Aufnahme und Verteilung von Schutzsuchenden. Die Zelte stehen auf Geröll – ein Regenguss und das gesamte Lager besteht nur noch aus Schlamm. In jedem Zelt sind dutzende Menschen untergebracht – in manchen sogar über hundert. Die Kommission hat angekündigt, Moria erneut zu einem Pilotprojekt zumachen. Wenn dem so ist, wird ihr Antrag als »unzulässig« abgelehnt. Direkt anschließen soll im Fall einer Ablehnung ein Rückführungsgrenzverfahren – ebenfalls unter Haftbedingungen. Dies soll ebenfalls bis maximal 12 Wochen dauern (Art. 41 Abs. 11, Art. 41a Abs. 2 neuer Entwurf für eine Asylverfahrensverordnung). Damit kommt man schon auf sechs Monate freiheitsbeschränkende Maßnahmen. Ähnliche Regelungen zu Zeitfristen gab es bislang auch schon – und wurden oft nicht eingehalten, zum Beispiel bei den aktuellen Grenzverfahren in Griechenland. Für manche Betroffene würde sich vielleicht auch eine Abschiebungshaft direkt anschließen, wodurch sie noch länger in Haft wären. Unter solchen Umständen sind faire Asylverfahren erst recht nicht möglich, insbesondere bekommen die Schutzsuchenden so nicht den notwendigen Zugang zu Rechtsberatung und –vertretung. Das ist aber entscheidend für rechtsstaatliche Verfahren. In der Vergangenheit wurden ähnliche Pläne, zum Beispiel bezüglich der Verteilung von Asylsuchenden aus Griechenland und Italien ab 2015, nur bruchstückhaft umgesetzt.
