Eilantrag stattgegeben, insbesondere interessant sind die

sind im Dublin-Verfahren als Nachweis von

ersuchende Mitgliedsstaat muss Dokumente nicht
übersetzen, der ersuchte Mitgliedsstaat muss im Rahmen
seiner Überprüfungspflichten ggf. Dokumente selbst
übersetzen (dies war lange zwischen dt. und gr. Dublin
Referat problematisch, inzwischen werden in der Regel
Übersetzungen von NGOs vom gr Dublin Referat
übermittelt)<br>

color="#000000">Die Familie wollte nach gemeinsamer
Antragstellung in Griechenland im Jahr 2016 gemeinsam
irregulär nach Deutschland weiterreisen wegen schlechter
Bedingungen in Griechenland. Die Familie wurde auf
der Weiterreise getrennt. Das Gericht nimmt eine
Ermessensreduzierung auf Null im Rahmen des Art. 17 Abs. 2
an und <span style="caret-color: rgb(0, 0, 0);">führt
unter anderem aus (S. 13):</span></font></div>

des der Antragsgegnerin eröffneten Ermessens
aus der Vorschrift des Art. 17 Abs. 2 Dublin
III-VO unmittelbar selbst. Denn der Konflikt
zwischen den beiden Grundentscheidungen der
Dublin III-VO, einerseits die über ein klar
skizzierte Zuständigkeitsregime gebotene
Beschleunigung der Verfahren si-
cherzustellen, andererseits die Wahrung
hochrangiger Rechtsgüter wie Familieneinheit
und Kindeswohl zu garantieren, kann im Rahmen
des Art. 17 Abs. 2 Dublin III-VO nur stets
zugunsten der humanitären Entscheidung gelöst
werden. Denn genau das ist Sinn und Zweck der
Vorschrift, die bei aller Formalisierung der
Verfahren zur Bestimmung der Zuständigkeiten
berücksichtigt, dass ein humanitäres Korrektiv
notwendig ist, wenn über- ragende Schutzgüter
drohen, Opfer rein formalisierter
Zuständigkeitserwägungen zu wer- den und
unverschuldete Fristversäumnisse zu nicht
hinnehmbaren Folgen für die Familie und das
Kindeswohl führt."</span></p>
