<p>Das Bundesministerium
des Inneren, für Bau
und Heimat (BMI) hat
einen Entwurf für ein
Zweites Gesetz zur
besseren Durchsetzung
der Ausreisepflicht
(Geordnete-Rückkehr-Gesetz)
vorgelegt, der die
gesetzlichen Hürden
für Abschiebungen
verringern soll.</p>
<p>Faktisch verringert
das Gesetz vor allem
bestehende
Integrationsperspektiven
und sieht eine
vollständige
Leistungsverweigerung
für bestimmte
Personengruppen vor.
Zudem räumt es der
Exekutive umfassende
Befugnisse und weite
Ermessensspielräume
ein, die Kernelemente
des
Rechtsstaatsprinzips,
im Hinblick auf die
Bedingungen der
Abschiebungshaft,
infragestellen.</p>
<p>Der Gesetzentwurf ist
in vielfacher Hinsicht
problematisch, wobei
drei Aspekte besonders
hervorgehoben werden
sollen:</p>
<ul>
<li>die Einführung
einer
“Duldung-light”,</li>
<li>die Verweigerung
von Leistungen für
bestimmte begleitete
Kinder und
Jugendliche und</li>
<li>die Ausweitung der
Abschiebehaft.</li>

wird nun nach

Leistungen der Kinder-
und Jugendhilfe ab
Einreise anerkannt und
ein Hilfesystem für die
Familien installiert
- mit dem Hinweis, dass
die Unterbringung in
dieser Einrichtung nicht
Familiengerecht ist. In
anderen AnkER-Zentren in
Bayern und im
Bundesgebiet bleiben
Familien in
kindeswohlgefährdenden
Wohnsituationen
weiterhin in der Regel

BumF-Landeskoordinatorin Irmela Wiesinger den Fluchtmigrationsprozess
insbesondere in seinen

Identitätsbildung
junger Geflüchteter
dar. Fach- und
Leitungskräfte sollen
hierdurch für die
psychosozialen Bedarfe
von geflüchteten
Jugendlichen und
jungen Volljährigen
sensibilisiert werden.

werden u.a. die
widersprüchlichen
Doppelaufträge an die
jungen Geflüchteten

Jugendhilfesystem
kritisch bewertet.</p>
