Zeit häufen
sich Berichte

Abschiebungen
und
Abschiebungsversuchen
– auch aus
Jugendhilfeeinrichtungen
heraus. Die
wichtigsten
Fragen in
diesem Kontext
haben wir
daher
gemeinsam mit
der
Bundesweiten
Arbeitsgemeinschaft der Psychosozialen Zentren für Flüchtlinge und
Folteropfer
e.V. (BAfF)
und dem
Rechtsanwalt
Leuschner in
einer
Arbeitshilfe
beantwortet.</p>
<p>Dürfen
unbegleitete
Minderjährige
überhaupt
abgeschoben
werden? Was
sind die
Anforderungen
an Behörden
bei einer
Abschiebung?
Darf der
Vormund bei
einem Termin
bei der
Ausländerbehörde
weggeschickt
werden? Darf
sich die
Polizei zum
Zweck der
Abschiebung
Zutritt zu
einer
Jugendhilfeeinrichtung verschaffen? Wie können sich die Jugendlichen und

<p>Bereits am 28.
November 2018 hatte
der BumF die im<em>
Gesetz über
Duldung für
Ausbildung und
Beschäftigung</em>
vorgesehenen
Änderungen im Rahmen
seiner Stellung zum
Fachkräfteeinwanderungsgesetz bewertet: Statt der angekündigten und
notwendigen
Verbesserung
enthielt der Entwurf
neben wenigen
Verbesserungen
erhebliche
Verschlechterungen
für die Integration
schutzsuchender
Menschen.</p>
<p>Auch nach der
Überarbeitung und
Ausgliederung der
Regelungen in den
Entwurf eines<em>
Gesetzes über
Duldung für
Ausbildung und
Beschäftigung</em>
bleibt diese Kritik
bestehen. Die Ziele
der Schaffung von
Rechtssicherheit für
Betriebe und
Auszubildende, einer
einheitlichen
Anwendung der
Ausbildungsduldung
sowie einer
Gewinnung von
Fachkräften werden
nicht nur verpasst,
sondern insbesondere
durch die
Neuregelungen bei
der
Identitätsklärung
sogar behindert.<br>

Verwaltungsgericht Berlin
hat am 01.02.2019 (VG 15 K
936.17 V) entschieden,
dass der Anspruch auf
Elternnachzug zu einem
minderjährigen
Geflüchteten, der eine
Anerkennung nach der

Flüchtlingskonvention
erhalten hat, auch nach
Volljährigkeit weiter
